Joseph Echavarria is a San Antonio native who built his career inside Bexar County courtrooms. He served two years as an Assistant Criminal District Attorney before moving to the plaintiff's side, where he has concentrated on personal injury and motor vehicle claims ever since, and has recovered tens of millions of dollars for his clients.
He graduated Summa Cum Laude from UTSA with degrees in Political Science and Criminal Justice, and earned his J.D. Cum Laude from SMU Dedman School of Law in 2007. He founded JRE Injury Law to represent injured Texans directly in his hometown and beyond.

Texas generally gives you two years from the date of the injury to file suit. Claims against a governmental entity — a city bus, a transit authority, a municipal vehicle — carry much shorter written notice deadlines, sometimes as little as six months. Missing either deadline usually ends the claim outright.
Texas uses modified comparative fault with a 51% bar. If you're found 50% or less responsible you can still recover, reduced by your share of fault. At 51% or more you recover nothing. Insurers know this rule and push fault onto you early, which is why what you say in a recorded statement matters.
Nothing up front. We work on contingency: our fee is a percentage of what we recover, and we advance the costs of building your case. If we don't recover for you, you owe us no fee.
It depends on your economic losses — medical bills, future treatment, lost income, property damage — plus non-economic damages for pain and impairment. Available insurance coverage often matters as much as the injury itself, especially in commercial vehicle cases where several policy layers may apply.
Not before you talk to a lawyer. Adjusters open with a recorded statement and a quick offer for a reason: both are easier to get before you know the full extent of your injuries. You are not required to give a recorded statement to the other side's carrier.
Get medical attention, photograph the scene if you're able, and get the carrier's name and DOT number off the door of the truck. Then call an attorney quickly — electronic logs, dashcam footage and engine data are subject to retention windows, and a preservation letter needs to go out before that evidence rolls off.
Some claims resolve in a few months; serious injury cases often take a year or more. It depends on how long you are still treating, whether liability is disputed, and whether suit has to be filed. We don't recommend settling before your doctor can say where you'll end up.
Your own uninsured/underinsured motorist coverage may respond, and in a work-related crash there may be an employer policy behind the driver. Part of our early work is finding every policy that could apply, not just the obvious one.
Usually some combination of health insurance, med-pay coverage on your auto policy, and providers who treat on a letter of protection. Those bills and liens get negotiated at the end, and reducing them is part of what determines how much you actually take home.
Most cases settle. But cases prepared for trial settle for more, which is why we build every file as though a jury will see it. If the carrier's best offer isn't fair, we're prepared to try it.
Yes. Texas limits who may file a wrongful death claim — generally the surviving spouse, children and parents — and the estate may bring a separate survival claim. We manage the statutory side so families don't have to.
